No loss of collective role, govt tells HC

Even as a Division Bench of the Kerala High Court on Tuesday reserved its verdict on a writ petition against the continuance of Pinarayi Vijayan as Chief Minister, the State government submitted before the court that there had been no loss of collective responsibility by the Council of Ministers.

The government made the submission when a quo warranto writ petition seeking a declaration that Mr. Vijayan was not entitled to continue as Chief Minister came up for hearing.

The petitioner, R.S. Sasikumar, former Syndicate member of the University of Kerala, sought a declaration as the Cabinet had lost the collective responsibility following the filing of a writ petition by Thomas Chandy, former Minister, against a report of the Alappuzha Collector and abstaining of four CPI Ministers from a Cabinet meeting on November 15.

The Advocate General submitted that the decisions taken by the Cabinet were accepted by these Ministers. Therefore, no question of breach of collective responsibility of the Cabinet did arise.
